What to do if money is stolen from the card? Punishment for stealing money. What to do if money is stolen from a Sberbank card

Each owner of a plastic card worries about the safety of his funds. Asking the question whether it is possible to steal money from a Sberbank card, the answer, unfortunately, is not comforting - it is possible, and in several ways. You will learn more about what to do if the plastic itself or money is stolen from it, you will learn in this material.

With the development of Internet technologies, the improvement of fraud from the global network is not lagging behind.

When a Sberbank card is stolen, this is a separate type of theft, simple enough that an attacker can use it to withdraw or transfer funds, especially if he also got a pin code.

But there are various fraudulent transactions with which money can be withdrawn:

  1. ... Special devices are placed on an ATM or terminal that allow you to find out the entered PIN code and read information on a magnetic tape, which is used to create counterfeit plastic - money is already stolen from a duplicate of your real plastic.
  2. Shimming. A more advanced version of skimming, it works on a similar principle.
  3. Phishing. Fraud on the Internet, with the help of which the client's secret data is requested and stolen (card number, secret code, passwords for online banking, etc.). In this case, your money will be able to pay for any product on the Internet.

Who is responsible for the stolen money?

If the money is stolen by malefactors in one of the ways listed above, then it will be difficult to prove their innocence. After all, the criminals use the data that the client has. The Bank acts in this situation from the position of non-disclosure of classified information and is not responsible for the actions of fraudsters. There are basic rules that will allow you to secure your funds from such actions.

Now there are many ways how to steal money from a Sberbank card

Anti-theft measures when using an ATM

In order not to steal money from a Sberbank card when using an ATM, you should follow a few simple precautions:

  • Choose an ATM, a terminal that is located in the bank branch itself, in a trade institution with a good security system, and other similar institutions.
  • Inspect equipment for devices of unknown purpose.
  • Do not show when typing and do not tell anyone the numbers from the pin code.
  • In the event of atypical situations when using an ATM (freezing, non-delivery of cash), report to the Bank's Contact Center.

Despite the reliability of ATMs, fraudsters continue to improve their "skill"

Potential bank failures - not to be confused with theft

According to reviews, there is another option, how easy it is to steal money from a credit card using an ATM: after a request for cash withdrawal, bills are not issued, and the amount is debited from the account. This may be accompanied not so much by fraudulent activities as by equipment malfunction.

In this case, it is better to do this:

  • Call the bank, report the problem - the money has been written, but not issued.
  • If an ATM of this credit institution was used, after the collection and recalculation of bills, the client will be credited to the account with the earlier withdrawn amount.
  • If the ATM of another bank, the process will be longer, since the transfer of information will come from it.
  • If an error is detected in the operation of equipment or the installation of fraudulent devices, they will be eliminated.

Useful Keep in mind that there have been cases of fraudsters installing whole fake ATMs, so you shouldn't neglect to call the bank. For this there is.

How can you protect yourself from online fraud?

When the Sberbank card was stolen and the money was withdrawn, this is one question. But what about virtual operations and how to protect them? Most often, scammers on the Internet use the following means to obtain passwords and personal data:

  • Viruses.
  • Sending letters supposedly from a bank demanding to provide passwords and other data.
  • Links to a fake page that looks like a bank page where you need to enter passwords.
  • Filling out a questionnaire for participation in a promotion or a prize drawing, where they may be asked to enter passport data, credit card number, etc.

How to recover money stolen from a Sberbank card?

Whether the bank will return money stolen through an online bank or other remote services remains open. It will not be easy to prove that the client is not involved in the transfer of funds, because this indicates data that he should not transfer to outsiders.

Returning stolen money is problematic enough

Therefore, you should pay more attention to letters, systematically check your computer for viruses and use additional protection measures. For example, you shouldn't follow the link sent in the letter. It is better to go to the bank's website using a search engine and check for a promotion or special offer. If you have received a request to check your personal data, it is better to call the official number (not the one indicated in the letter) and clarify what it is for. Usually, the bank does not need such information.

Theft of money using the customer's phone number

There is another type of fraud that happens quite often at the moment. Therefore, we will consider how to return stolen money from a Sberbank card using a phone. It looks like this: the client does not receive an SMS about the withdrawal of funds, and subsequently discovers that the money has been withdrawn from the account. During the investigation, it turns out that they were transferred to his phone connected to the card, and from him to another phone number. This happens by counterfeiting or receiving an updated SIM card of the phone and disconnecting the client's SIM card as outdated.

How to prove that money was stolen from you?

As the experience of the victims testifies, it is very difficult to prove the fact of theft.

You need to contact the following structures:

  • Write a statement to the bank about disagreement with the operation.
  • File a report with the police.
  • Contact the operator with a request to indicate the numbers to which the money was sent, and explain under what circumstances the SIM card was replaced.

The process is quite complicated and rarely gives a positive result, as practice shows. By the way, the application must be sent as soon as possible in case of any error detection. You can only express disagreement with the operation within a month.

Card insurance - why do you need it?

If you do not want to worry about the safety of your funds, then you should take advantage of the bank's offer and take out an insurance policy "Card Protection".

The easiest way to save funds is to insure them.

This option provides for collateral against several types of risks.

To begin with, it should be noted that theft of money from a card is not a special case of theft, because the criminal law establishes a separate article (), which provides for a rather serious liability for fraudulent actions using credit or debit cards.

In our article, we will describe the types of such fraud, as well as establish an algorithm of actions that should be taken by the victim in such cases.

We will also figure out whether the bank will return the money stolen from the card.

How do they steal money from bank cards?

Actually, there are not so many such methods of theft from bank cards, plus, they appeared almost simultaneously with the appearance of plastic cards. It's just that from time to time, the methods of stealing money are slightly improved in technical terms. Those. scammers have not yet invented anything fundamentally new.

Traditional "offline" methods

  • The first and most primitive way possible only if the cardholder is inattentive. The fact is that many citizens still keep a secret pin - code (usually written on a piece of paper) along with the card itself. It turns out that if you have lost your wallet, then it will not be difficult for the person who found it to go to the nearest ATM, enter the code and reset the balance on your card.
  • The same applies to cases of loss of so-called chipless cards.... But now, the fraudster (and the one who found the card in the case of using the funds is) will not be able to withdraw cash, but he will be able to purchase goods in the nearest store without difficulty.
  • In the most technically difficult way installation of all kinds of reading devices on payment terminals. In such cases, the PIN code of your card is usually scanned, and then the fraudsters use the "backup" card, to which your money is transferred.
  • Another way of card fraud, see the video:

How can they steal money through a mobile bank

Situations when money is stolen from a card through a mobile bank are quite rare. This is due to the fact that security systems in many banks make this scheme extremely difficult to implement, but nevertheless sometimes takes place.
If you go into the technical component of this scheme, then it consists in the fact that neither SMS message nor the requirement to enter a one-time key comes to your phone when transferring funds. This is due to the fact that some cellular operators are extremely negligent about the safety of their customers, and fraudsters can (with a serious approach to business) install a so-called blocker (or interceptor), with the help of which SMS with a code will not be sent to the number associated with the card , and on the phone of intruders.

At the same time, in the account statement, later it will be possible to find the details to which the funds were transferred. It turns out that you didn’t lose anything, you didn’t tell anyone the code, but the money from your account miraculously disappeared. As a rule, contacting the bank for an explanation of the situation does not give anything, because the transaction is indicated in the statement, and the code sent by the bank was used. Why demanding something from the bank in such cases is useless, we will tell you about the example of the bank # 1 in Russia.

What to do if money is stolen from a Sberbank card

Unfortunately, the most reliable bank in the country, like all the others, cannot fully ensure the safety of funds on plastic cards issued to citizens. The fact is that, as we have already said, not always everything depends only on the bank. Plus, whether Sberbank will return the money stolen from the card from the card directly depends on the following factors:

    • whether a PIN code was used during the transaction
    • degree of guilt (negligence) of the cardholder
    • whether a criminal case has been opened with the subsequent establishment of the fact of fraud

It turns out that if money is stolen from a Sberbank card (regardless of the method), it is not possible to return it in all cases.

Using a pin - code

In the relevant federal law, there is a rule according to which it is established that the bank is not responsible for the safety and security of funds during transactions using a pin code.

It turns out that if money is stolen from your credit card by entering a pin - code (which by default is known only to you), then the bank has every right not to return the funds to you. After all, banks do not yet have the ability to track who exactly enters your secret code. After all, in fact, it could have been you, but now you just decided to "weld" at the expense of the bank. This does not happen, and if the pin code was not used by you, then you should urgently contact the law enforcement agencies.

Criminal proceedings

If the attackers managed to steal money from a bank card belonging to you, and the bank insists that the PIN code was used, then contacting the police is mandatory, because one should not hope for the leniency of Sberbank.

Even if a criminal case is initiated and the fact of theft of money is proven, the return of such money should not be demanded from the bank, but from the attacker. This is usually done by filing a parallel claim against fraudsters.Therefore, the answer to the question regarding how to return the money stolen from the card depends on whether the bank is to blame (erroneous write-off, payment that did not reach the addressee, etc.). etc.).

How to recover money stolen from the card?

The procedure for returning money stolen from the card is as follows. If you find that a certain amount has disappeared from your card account, then of course you should first contact your bank, but not with a demand to return the money, but with clarification of the circumstances in which the withdrawal became possible. The bank employee will provide you with a statement of the account with the latest transactions, which can be used to determine what, when and where was transferred.

Next, you should act based on the above scheme: if the pin - code was used, we contact the police, but if not, then we demand a refund from the bank, possibly even through a court. After all, the situation can be aggravated when money is stolen not from a debit account, but from a credit one. After all, the bank will demand a refund from you, and even with interest. In such cases, you should again immediately contact the law enforcement agencies, and the results of the check (as well as some materials of the criminal case) that admit (established) the presence of a fraudulent scheme should be submitted to the bank so that it stops demanding money from you, for theft which you are not related to.

Much depends on the bank itself, but most, in most cases, law-abiding and self-respecting banks return the money themselves, without resorting to court procedures.

Modern realities bring progress and innovation to all spheres of human life. Banking is no exception and, unfortunately, scammers regularly invent more and more sophisticated ways to take other people's funds.

You should not violate the rules for the use of bank plastics so as not to become a victim of thieves

Each bank is interested in the safety of the client's funds. But quite often on the Internet you can come across requests "what to do when stealing money from the card", "stole money from the card what to do".

What to do (Workflow)

So, if money was stolen from a Sberbank bank card, and also, in order to significantly increase the chances of their return, the following steps should be taken immediately:

  • at the first suspicion of illegal movement of funds, it is necessary to block the card, for which call 8-800-55-55-5-50;
  • try to remember if you have any unpaid fine, have paid for service, made purchases;
  • arrive at the nearest branch of a financial institution, write a statement stating that you did not consent to this transaction.

When detecting theft, you should not panic, but keep calm

If, after an internal investigation, it turns out that the funds were not withdrawn by you, the bank must return the lost amount. When the bank's investigation did not end with the return of the required amount, then 2 options are possible further:

  • contact the police about illegal actions with your card;
  • write a statement to the prosecutor directly to the bank, which can also help recover the stolen funds.

How to avoid stealing money from a Sberbank card

If your money was stolen, then do not rush to blame all your sins on the bank. Quite often, we ourselves are to blame for what happened.

Protective measures

In order to prevent the theft of money from a bank card, you must adhere to basic rules:

  • when withdrawing funds, do not allow someone else to be nearby, since a few seconds are enough for this person to remember the cvv code;
  • never use SNS to confirm an operation if it is not you.

If someone "works" with your plastic, then problems immediately arise in the functioning of your personal account (for example, the operation you are carrying out is interrupted, after which you must first enter the password to continue working).

How money is stolen from a card

There are many ways to steal funds virtually. Most often, funds are lost in this way:

  • phishing- theft using the network. Unfortunately, our clients' personal data are poorly protected. After, for example, the scammers already have your phone number (and you can get it simply: take it from acquaintances, friends, or your phone is simply lost), they send out information about blocking such and such a card, to which the phone number is also attached. Usually, they keep it for no more than 2 days, and fixing its whereabouts is not so easy, given our bureaucracy in law enforcement agencies: while they accept a statement of loss, then they demand to fill out many forms and other papers, etc.

Then they call the client, provided by the bank officer. At the same time, it is recommended that you go to a certain ATM, change your password or some personal data, after which the situation will be corrected. The potential victim should be aware that they never advise to go to a bank branch and do it there. A mini-camera or an overhead keyboard installed on an ATM facilitates the leakage of information, which is successfully used by fraudsters, and money easily "floats away".

Have you been cheated in the store? Has your money been stolen? In response, are you going to tear and throw? I've done this before too. Now there is no.

Why? I just have a theory. Monetary. I developed it not so long ago, but since then I not only don’t worry when they cheat me in money matters, on the contrary, I’m happy.

What's the theory?

I answer: money should be received by earning money, as a gift. In general, any legal way. If there is a temptation to get them illegally, then life punishes - it takes this amount at the most inopportune moment (however, when there is a right moment for this?) The opposite is also true: if someone took money from you, it will be returned to you.

If we recall the sister of talent, then we can put it more succinctly: you give and receive; take away - they take away from you.

Of course, what is the theory without proof? I will give them to you.

Proof # 1

To begin with, I will talk about a small amount of money. Somehow, 7-8 years ago, they gave me an extra UAH 10 in the store. I only noticed this at home. I did not return.

With thoughts: “All the same, the shops often cheat. Serves them right! ”I went to bed. The next day I was cheated in another store for the same amount.

Proof # 2

When I was about 23 years old, money was stolen from me. UAH 100 Then for me this amount was global. My husband and I paid off the loan, and therefore could not afford to throw money.

How did the theft happen? I walked up to the tent with jeans in the market. I felt that I was surrounded on all sides. Instead of moving away from there, I thought: "Yeah, a whole crowd needed my jeans, we urgently need to move even more!" After a while, I felt that my breathing became freer. Aha, competitors could not stand it! I happily reached into the pocket of my bag to pay for the jeans, but ... I didn't find the money.

I cannot convey to you the feeling that overcame me. If you think about it, then 100 hryvnia is still not enough money to be killed because of it. But I got scared. So, in broad daylight, you can violate your personal space ... Assign mine.

But let's not go deep into psychology ... I'd rather tell you what happened the next day.

At work, one tough client agreed to open a checking account. For this, the employee, that is, in this case, I was entitled to a bonus. Guess which one? UAH 100

Proof # 3

This story happened in December last year. I ordered things from 2 online stores. In one - linen for yourself, and in the other - dresses for my daughter. Delivery times were different there. From a store with adult clothes, I received the package earlier. It turned out to be 1 more linen. It cost 80 UAH. That is, I actually stole this amount from the store. I began to think - to pay extra or not for an extra thing.

But my reflections were interrupted after 5 minutes. A manager from another store unsubscribed to me. They say that the dollar rate has risen, and therefore instead of UAH 500. it is necessary to give 600 hryvnyas.

I wanted to pay right away, but something stopped me. The dollar has not soared to the same extent, so that as much as 100 hryvnia surcharges! Then I asked her to decrypt my payment.

As soon as everything was clarified, I phoned the first store, said that I would take the extra thing, and transferred the money for it. By the way, the girl there did not immediately understand what I wanted to do: “So that because of the lack of things, things would ring, I understand that, it was, but so that, like you, because of the excess, this is the first time.” In general, she clearly decided that she was dealing with a deranged woman. :)

Doubts?

You probably noticed that in these 3 cases, I did not control the process. "Accident! Coincidence!" you say and you will most likely be right. I myself doubted to the last, and therefore decided to check.

If you remember, my theory has the opposite: you give and receive. I planned an experiment: to become an initiator - to give someone my honestly earned money on purpose. Will they come back to me? Listen further ...

Money experiment

So, I decided to give money to someone. Just. But not 10-50 hryvnia, otherwise you might not notice how they return.

I decided to take 10% of the family budget. Decided ... but didn't. Because my theory has an addition. It is easy to give money away.

And to give me 10%, well, to put it mildly, it's difficult. It will be so hard for me, my husband. :)

So I decided to start with 500 UAH. Also a decent amount, but what can't you do for the sake of a quirk ... that is, science!

After the amount was determined, I started looking for an object. Of course, I could just give it to a relative, I, in principle, thought so. But (the animal runs to the catcher!) In the evening I saw a program on local television. In our city, one man has been feeding people without a fixed abode for several years with his personal money.

Why is he doing this? The answer is simply amazing. Previously, he was a businessman, a famous person in the city, but at some point he came home and suddenly, without any preconditions, he was paralyzed.

For four months he lay without getting up. Doctors, as usual, took money for treatment, but they could not even make a diagnosis.

Gradually, despite treatment from an unknown illness, he began to recover. When he finally got to his feet, he became a kind of hermit. He quit his business, moved to a village, took up farming and began to help people deprived of a roof over their heads. He organizes dinners for them several times a week.

So I decided to give him 500 UAH. The husband, by the way, agreed easily. I was even delighted. Said:

If your strange monetary theory is refuted for only 500 hryvnia, then we will get off cheaply. But then at least we will live like all normal people, heap ...

Then he coughed. Strange, why would? Didn't seem to eat at that moment. In general, I still did not understand what he meant by "normal people."

So, at lunchtime, my daughter and I went to the place where the meal was taking place for the disadvantaged, and handed the money.

Now get ready. The next day, my husband brought home 500 UAH. I am shocked! In my husband, this is generally a condition that is not amenable to definition. Apparently, he was completely stunned by the thought that we would not become "normal people".

What kind of money was it? It turns out that they were given an award at work. Their company successfully expanded, and the chiefs, in joy, gave the workers money. It should be said here that their company has expanded more than once, but they have never been awarded for this.

Theory and me

Well, how can I doubt after that? This is how we live with money in peace and harmony. :)

By the way, people are usually surprised by my behavior. For example, in stores, I always return the extra change. Sellers do not understand at first, do not believe. They think that I, on the contrary, demand more money from them. :) And when it comes to them, they look happily, but with some suspicion. Like, why would she want to return the excess? There would be no way to live like all normal people!

Well, what's wrong with that? I have a theory :) By the way, it's strange that everyone is trying to give me too much ... Think about another theory? ..

Girls, what do you think? Is it an accident or a pattern? Maybe you have noticed similar cases in yourselves?

"Plastic" is now not a luxury, but an integral part of our wallet. Even pensioners are persuaded to issue plastic cards to receive pensions and benefits. Well, how can you not profit here? .. So carders are scouring all over the world in search of DUMPS and PIN-codes, and as a result -. The matter is clear, you must immediately run to the bank, and there, at best, they shrug their shoulders, at worst, they draw a muzzle in front of their noses: “Like, you’re a fool, you had to watch. We will not return the money! "

Help, the money was stolen!

Approaching an ATM one fine day with an innocent desire to get some cash, you suddenly found that money:

A) not at all;
b) today, well, very little, but yesterday it was well, very much.

As a rule, the first thought: “Stole it!”, Then the brain vigorously recalls how the villains got access to the card, and finally: “Oh, my mother told me to connect SMS banking, do not show the card number on the Internet and do not pay with“ plastic "For Chinese jeans at Cherkizovsky." Well, they seem to have thought of everything. Calmed down a bit.

Forward, towards difficulties

We call the bank as soon as possible and report the incident. You don't have a phone number for your bank's plastic card department or 24/7 customer support? It is not surprising that you were robbed ... When you receive an envelope with a plastic card, we strongly recommend that you write down these numbers on your mobile or in a notebook if you are still using it. After receiving a message from you, the bank blocks the card.

Then we follow to the police, but not to a simple department, but straight to the department or department for combating economic crimes (OBEP, UBEP). We write a statement and give explanations - in general, we inform the operatives all the information they are interested in.

It's time to talk to the bank employees. We order an extract with a list of transactions (monetary transactions carried out using your card). Naturally, we will find transactions unknown to us there. We write a statement in any form to refuse these transactions. We keep a copy with a mark on the receipt of the application. The bank will inform you that an internal investigation will be carried out in your case, the time frame for which can vary from several weeks to several months. Based on the results of the investigation, you will be informed about the decision made by the bank.

While the investigation lasts, there is no need to sit idly by. With a high degree of probability, the money from the bank will have to be scraped out through the court, so we will stock up on evidence. We provide ourselves with an alibi, that is, our task is to prove that at the moment of the theft we were in a completely different place, surrounded by completely different people. This will help us:

  • witnesses;

  • documents - railway - air tickets, hospital certificates, protocols of administrative offenses, etc .;

  • video recordings from cameras installed in the ATM, or surveillance cameras located nearby. Nobody will give you the recordings just like that, so you will have to either negotiate for money, or act through the Department of Economic Crimes, who, as we remember, collect material at our request.

  • At the end of the bank investigation, you either receive the money, or you are politely denied it. Then it's up to you to decide whether to go to court or not.

    If you decide to sue the bank, then get ready for a good fight, as:

  • the bank will defend its position to the end;
  • banks do not keep bad lawyers on staff.

  • And this is despite the fact that the dispute is regulated by the Law "On Protection of Consumer Rights", however, the obligation to prove their position has not yet been canceled. Therefore, if you are not a professional lawyer, we strongly recommend using his services.

    Your task is to convince the court that the withdrawal of money from your account was made without your knowledge. At the same time, the remarks of bank lawyers about your improper storage of information about the card can be suppressed by the requirement to prove the fact of improper storage or use, and this is practically unprovable, unless you yourself declare that standing at the ATM loudly shouting your PIN number and only deaf with they didn't write him down as lazy.

    Even the thunderstorm of all banks, namely the Central Bank of the Russian Federation, was puzzled by this problem and could not resist recommending something of this kind to the owners of plastic cards. The recommendations are contained in the Letter of the Central Bank of the Russian Federation dated December 7, 2007 No. 197-T "On risks in remote banking services":

  • exclude the possibility of illegal receipt of personal information of users of RB systems (not to transfer to unauthorized persons);
  • carry out transactions using ATMs installed in safe places (in government agencies, bank divisions, large shopping malls, hotels, airports, etc.);
  • do not use bank cards in trade and service organizations that are not credible;
  • when making transactions with a bank card without using ATMs, do not let it out of sight;
  • do not use devices that require entering a PIN code to access the room where the ATM is located;
  • not to use the PIN code when ordering goods or services by phone / fax or via the Internet;
  • if there is an opportunity provided by a credit institution, use the details of a single-use card (the so-called "") to pay for goods or services via the Internet;
  • use the service of SMS-notifications about operations performed with the use of RBS (if it is possible to receive such a service);
  • carry out information interaction with the credit institution only using communication means (mobile and landline telephones, faxes, interactive websites / portals, regular and e-mail, etc.), the details of which are specified in the documents received directly from the credit institution.
